11. Giriş

Sitewagon'a ("Şirket", "biz", "bize", "bizim") hoş geldiniz. Bu Hizmet Şartları ("Şartlar"), web sitesi geliştirme hizmetlerimizin, web sitemizin ve ilgili tüm hizmetlerin (topluca "Hizmetler") kullanımınızı düzenler. Hizmetlerimize erişerek veya kullanarak bu Şartlara bağlı kalmayı kabul etmiş olursunuz. Bu Şartları kabul etmiyorsanız Hizmetlerimizi kullanamazsınız.

2About GOLDENROCK MONTENEGRO DOO

Sitewagon is a brand operated by GOLDENROCK MONTENEGRO DOO, a company organized and existing under the laws of its country of registration. GOLDENROCK MONTENEGRO DOO is the contractual partner providing the Services, issuing invoices, and handling billing, support, and account management related to Sitewagon.

References in these Terms to "Sitewagon" or the "Service" describe the platform and tools you use, while references to "GOLDENROCK MONTENEGRO DOO" identify the legal entity with whom you are entering into this agreement.

32. Hizmetlerimizin Kullanımı

You agree not to use the Services for any unlawful, harmful, or prohibited purpose. This includes, without limitation, using the Services to host or distribute illegal content, infringe intellectual property, violate privacy or data protection laws, or engage in fraud, abuse, or any activity that could damage our infrastructure or reputation.

• ✓You must comply with all applicable local, national, and international laws when using the Services.
• ✓You must not attempt to gain unauthorized access to any systems, networks, or data belonging to GOLDENROCK MONTENEGRO DOO or to other users.
• ✓You must not use the Services in a way that could disrupt, overload, or impair the proper functioning of the platform.

4Account Registration & Security

53. Fikri Mülkiyet

Sitewagon tarafından Hizmetler kapsamında oluşturulan tüm içerik, tasarım ve materyaller (sizin tarafınızdan sağlanan önceden mevcut materyaller hariç, "Müşteri İçeriği"), Sitewagon'un fikri mülkiyetidir. Upon full payment of all applicable fees, we grant you a worldwide, royalty-free, non-exclusive license to use the final website or project output for your business or personal use, subject to these Terms and any specific usage limitations set out in your plan.

• You retain all ownership rights to your Client Content, including any text, images, logos, or other materials you provide to us, provided you have the legal right to use such content.
• You may not copy, modify, reverse engineer, distribute, or create derivative works of the Sitewagon platform, templates, or underlying software except as expressly permitted by law.
• We may display anonymized or non-confidential examples of work created using the Services for marketing or portfolio purposes, unless you explicitly request otherwise in writing where applicable.

64. Müşteri Sorumlulukları

Bir müşteri olarak, gerekli tüm içerik, görsel ve bilgileri zamanında sağlamaktan siz sorumlusunuz. Bu materyallerin geç sağlanması proje gecikmelerine yol açabilir. Bize sağladığınız tüm içerik üzerinde yasal haklara sahip olmalısınız.

• ⚠You confirm that you have the legal rights (licenses, permissions, or ownership) to all content you provide to us or upload using the Services.
• ⚠You must not use the Services to host, share, or promote content that is illegal, harmful, defamatory, hateful, misleading, or otherwise inappropriate.
• ⚠You are solely responsible for complying with any laws that apply to your website or project, including consumer protection, e-commerce, data protection, and tax regulations.

75. Ödeme Koşulları

Hizmetlerimizin ücretleri ayrı bir teklif veya sözleşmede belirtilecektir. Genellikle, işe başlamadan önce bir ön ödeme alınır ve kalan bakiye proje tamamlandığında ve nihai web sitesi yayına alınmadan önce ödenir. Tüm ödemeler iade edilmez.

• We may require upfront payment, deposits, or recurring subscription charges, which will be processed by GOLDENROCK MONTENEGRO DOO or its appointed payment processors.
• You authorize us and our payment processors to charge your selected payment method for all applicable fees on the billing schedule associated with your plan.
• If a payment cannot be collected (for example, due to expiration, insufficient funds, or disputes), we may suspend or limit your access to the Services until the outstanding amount is settled.

Unless otherwise stated in our Refund Policy or required by applicable law, all payments are non-refundable. For details on when refunds may be available (for example, in connection with a money-back guarantee), please refer to our separate Refund Policy published on the Sitewagon website.

8Data Protection & Privacy

We process personal data in accordance with our Privacy Policy, which describes how we collect, use, share, and protect your information. By using the Services, you acknowledge that your personal data will be handled as described in our Privacy Policy.

If you collect or process personal data of your own users or customers through websites or projects built with Sitewagon, you are solely responsible for complying with applicable data protection laws (such as providing appropriate privacy notices, obtaining consent where required, and honoring data subject rights).

96. Gizlilik

Confidential information may be used only for the purpose of performing or receiving the Services and must not be disclosed to third parties except to professional advisers or service providers who are bound by confidentiality obligations, or as required by law or regulatory authorities.

107. Sorumluluğun Sınırlandırılması

Yasal olarak izin verilen en geniş ölçüde, Sitewagon dolaylı, arızi, özel, sonuç olarak ortaya çıkan veya cezai zararlardan ya da doğrudan veya dolaylı olarak meydana gelen kar veya gelir kaybından sorumlu tutulamaz.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Services shall be limited to the amount actually paid by you to GOLDENROCK MONTENEGRO DOO for the Services during the twelve (12) months immediately preceding the event giving rise to the claim, unless a different mandatory limit is set by applicable law.

118. Fesih

Taraflardan herhangi biri, diğer taraf bu Şartları ihlal ederse yazılı bildirimle hizmet sözleşmesini feshedebilir. Fesih durumunda, fesih tarihine kadar tamamlanan tüm işler için ödeme yapmanız gerekmektedir.

• We may suspend or terminate your access to the Services immediately if we reasonably believe that your use is unlawful, abusive, or poses a security or legal risk to us or to others.
• Upon termination, you remain responsible for paying all fees owed for Services provided up to the effective date of termination.
• We are not obligated to maintain or store your content after termination, except where required by law. You are responsible for exporting any data or content you wish to keep before closure, where such export features are available.

129. Geçerli Hukuk

Bu Şartlar, Sitewagon'un bulunduğu ülkenin yasalarına tabi olacak ve bu yasalara göre yorumlanacaktır. Çatışan hukuk kuralları dikkate alınmaz.

Where permitted by law, any disputes arising out of or in connection with these Terms or the Services shall be subject to the jurisdiction of the courts located in the same jurisdiction, unless consumer protection laws grant you the right to bring claims in your country of residence.

1310. Şartlardaki Değişiklikler

Bu Şartları dilediğimiz zaman değiştirme hakkını saklı tutarız. Herhangi bir değişiklik olduğunda yeni Şartları web sitemizde yayınlayarak sizi bilgilendireceğiz. Hizmetleri kullanmaya devam etmeniz, yeni Şartları kabul ettiğiniz anlamına gelir.

Where required by law or where changes are material, we may also provide additional notice (for example, by email, in-app notification, or prominent notice on our website). Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.
